TON Society ID - Terms of Use

Preamble

Welcome to TON Society ID. By using the TON Society ID(“Service”), you as the user (“You” or “Your”) are agreeing to be bound by these terms of use (“Terms”) of TON Society Limited a British Virgin Islands company (“We” or “Us” or “Our”), all applicable laws and regulations, and agree that You are responsible for compliance with any applicable local laws. If You do not agree with any of these terms, You are prohibited from using this Service. The materials contained in this Service are protected by applicable copyright and trademark law. We reserve the right to change these Terms at any time at Our sole discretion. The Terms in force at the time of Your use of the Service apply. Updated Terms are binding on You with respect to Your use of the Service on or after the date specified in the updated Terms. If You do not agree to the updated Terms, You must stop using the Service. Your continued use of the Service after the date of the updated Terms will constitute Your acceptance of the updated Terms.

1. About the Service

The Service is a form of digital identity also a Telegram Mini App allowing users to interact with other TON Society products, it allows:

  • user registration and authentication using his/her telegram account (i.e. it stores the relations between user's telegram account(s) and connects to the user's TON wallets);
  • users to establish identities for participating in TON Society's decentralized apps, blockchain services, or other TON-related activities;
  • users with the ability to browsing and editing their profile, where they could provide their name, photo, profile description and links (all these are optional);
  • users to receive new SBT badges (TON Society's onchain badges);
  • users to receive notifications (i.e. about New minted NFT badges or TON Society news);
  • user authentication on external services (i.e other Telegram Bots and Mini Apps) using his/her TON Society ID profile; and
  • users to participate in Leaderboards and receiving rewards.

2. Eligibility

By using Our Service, You represent and warrant that you (i) have the right, authority, and legal capacity to accept these Terms, (ii) will not use Our Service if the laws of Your country of residence and/or citizenship prohibit You from doing so in accordance with these Terms, (iii) are using our Service for Your own personal use.

3. Using the Service

We reserve the right to withdraw or modify the Service, and/or any services or materials or contents we provide on the Service, at Our sole discretion without notice. We do not guarantee that Our Service or any content on it will continuously be available or accessible without interruption. We will not be liable if for any reason all or any part of the Service is unavailable at any time or for any period. From time to time, we may restrict access to all or part of the Service.

We may need to suspend the provision of the Service from time to time to facilitate routine maintenance of the relevant systems and/or to update or modify the operation of the Service to reflect changes in the law, regulation or official guidance and/or the proper interpretation thereof. We will keep such interruptions to a minimum whilst still maintaining the integrity of the Service.

4. User Undertaking

You undertake not to:

  • use the Service to advertise, display, promote, make available or otherwise communicate the following contents to the public:

    • promotes or encourages illegal actions;
    • uses naturalistic images of violence against people or animals, erotic, pornographic materials, offensive materials, obscene language, swear words and expressions;
    • contains descriptions of the means and methods of suicide, and any incitement to commit it;
    • promotes and/or contributes to the incitement of racial, religious, ethnic hatred or enmity, promotes fascism or the ideology of racial superiority;
    • contains extremist materials;
    • promotes criminal activity or contains advice, instructions or manuals on performing criminal acts;
    • promotes online or offline gambling, gaming, or casino-based activities involving real money, prizes, or goods of any value;
    • contains election agitation for political campaigns, political parties, candidates, or promotes political or religious movements;
    • contains confidential information, including, but not limited to, state and trade secrets, private information about third parties;
    • contains advertising or describes the attractiveness of the use of drugs, including "digital drugs" (sound files that affect a person via binaural beats), information about the distribution of drugs, recipes for their manufacture and usage advice;
    • potentially may lead to illegal actions by misleading users or abusing their trust; and
    • violates other rights and interests of citizens and legal entities or the requirements of the legislation of the British Virgin Islands and other countries covered by the Service functionality.

  • employ scraping or similar techniques to aggregate, repurpose, republish or otherwise make use of any content from the Service; and

  • violate, bypass or circumvent any security measure intended to limit or prevent access to the Service or otherwise attempt to gain unauthorized access to the services provided on the Service, whether through hacking, unauthorized use of another 's person credentials or any other means.

5. Third Party Apps and Mini Apps

The Service may contain links to websites, Apps, Mini Apps and content that is controlled or operated by third parties ("Third Party Links”). We are providing these Third Party Links to you only for convenience and the inclusion of any Third Party Links on the Service does not imply any endorsement by Us of the Third Party Links and/or their operators. We are not responsible for any content contained in or associated with the Third Party Links.

6. Intellectual Property Rights

The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by Us, Our licensors, or other providers of such material and are protected by British Virgin Islands and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on Our Service without Our prior written consent. Our name, Our logo, and all associated names, logos, product and service names, designs, and slogans are trademarks of Us or Our affiliates or licensors. You may not use such marks without Our prior written permission. All other names, logos, product and service names, designs, and slogans on this Service are the trademarks of their respective owners. Under no circumstances does Your use of the Service grant You any ownership rights or other interest in any such marks or content on the Service.

You agree and undertake that you will not (i) reverse engineer or decompile the Service or any part thereof, or attempt to do so; (ii) access, or attempt to access, any areas of the computer system or other information thereon in relation to the Service (except as expressly provided as the use of the Service in the ordinary course through the relevant link); (iii) use any robot, spider, other automatic device, or manual process to “screen scrape,” monitor, “mine,” or copy the pages provided through the Service or the content contained thereon in whole or in part; and (iv) use any device, software or routine to interfere or attempt to interfere with the proper working of the Service, or (in each case) procure, enable, permit or assist any other person to do any of these things.

7. Disclaimer of Warranties

The use of the Service is made at Your own risk. You understand and agree that the Service is provided on an “as is” and “as available” basis and that We expressly disclaims all warranties or conditions of any kind, whether express, implied, statutory or otherwise. Neither Us nor any person associated with Us makes any warranty or representation with respect to the completeness, security, reliability, quality, accuracy, or availability of the Service. Without limiting the foregoing, neither Us nor anyone associated with Us represents or warrants that the Service, its content, or any services obtained through the Service will be accurate, reliable, error-free, or uninterrupted, that defects will be corrected, that our Service or the server that makes it available are free of viruses or other harmful components, or that the Service or any services or items obtained through the Service will otherwise meet your needs or expectations.

Based on the above, You should verify all information, before relying on it, and all decisions based on all information contained on our Service are Your sole responsibility and we shall not be liable for any such decisions.

8. Limitation of Liability

To the fullest extent permitted by law, in no event shall Us, our affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your access, use or inability to use, the Service or any content on the Service, including any direct, indirect, special, incidental, consequential, or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable.

By using the Service, you agree that no individual has or will have any personal responsibility to you for the Service provided.

9. Indemnification

You agree to defend, indemnify, and hold harmless We, our affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any third party claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

Please see our Privacy Policy to understand how we collect and use and disclose your personal data. By using the Service, you consent to all actions that may be taken by us with respect to your information in compliance with the Privacy Policy.

11. Feedback

We appreciate and encourage you to provide feedback on our Service. If you provide feedback, You agree that We are free to use it and may allow others to use it without any restriction or compensation to you. All feedback, comments and other communications relating to the Service can be directed to this form.

12. Modifications of the Service

We reserve the right to do any of the following, at any time, without notice:

  • modify, suspend or terminate operation of or access to the Service, or any portion of the Service, for any reason;
  • modify or change the Service, or any portion of the Service, and any applicable policies or terms; and
  • interrupt the operation of the Service, or any portion of the Service, as necessary to perform routine or non-routine maintenance, error correction, or other changes.

13. Violation of the Terms

We may disclose any information we have about You if it determines that such disclosure is necessary in connection with any investigation or complaint regarding the use of the Service, or to identify, contact or bring legal action against someone who may be causing injury to or interference with Our rights or property. We also may disclose such information when applicable law requires or permits such disclosure, including exchanging information with other companies and organizations for fraud protection purposes.

We may, at our sole discretion and without prior notice, terminate the access to the Service, if We determine that You have violated any provision of these Terms or other agreements, or guidelines which may be associated with the use of the Service.

If We do take any legal action against You as a result of Your violation of these Terms, We shall be entitled to recover from all reasonable fees and costs of such action.

14. Changes of the Terms

We reserve all rights, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material, We may provide reasonable notice prior to any new terms taking effect. The continued use of the Service will constitute an acceptance of the revised Terms. What constitutes a material change is determined at Our sole discretion.

15. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the substantive laws of British Virgin Islands. The application of the United Nations Convention on Contracts for the International Sale of Goods shall be excluded. Any dispute arising out of or in conjunction with these Terms shall be submitted to the exclusive jurisdiction of the ordinary courts of the British Virgin Islands.

If any of the provisions of these Terms are found to be unenforceable for any reason in any jurisdiction, the remaining provisions shall not be affected.
